Nydus Open Learning

For all learners, parents, and guardians: who operates Open Learning

Nydus Foundation is the operator and data controller for Nydus Open Learning (“Open Learning”), a learning platform for people of all ages. It is intentionally available to children with guardian-managed profiles. Adults may create self-learning accounts for themselves. A guardian-managed child profile is linked to an adult account; the guardian represents that they are authorized to create and manage it and will keep their relationship information current.

What we collect

For each learner account or profile, we collect: alias or display name; age band; country of habitual residence; language; accessibility preferences; course activity; submitted answers; grading results; hints; mastery evidence; review schedules; and security and synchronization logs. An adult account may require account credentials and contact information for account administration; a child profile does not require a child email.

We deliberately do not collect from child profiles: email address, surname, address, precise location, school name, contacts, photograph, voice, or health diagnosis. Please do not put those details in answers or free-text fields. If they are provided, contact us so we can remove them where possible.

Why we use information

• Alias, age band, country, language, and accessibility preferences: create an appropriate, accessible learning experience and apply country-specific settings.
• Course activity, answers, grading, hints, mastery evidence, and review schedules: deliver lessons, assess responses, calculate progress and review timing, show feedback, and improve course quality and reliability.
• Account, security, and synchronization logs: authenticate access, protect accounts, detect abuse or faults, preserve offline work, and synchronize it across a learner’s authorized devices.
• Guardian relationship and adult contact information: obtain and record authorization, enable oversight, respond to requests, and meet legal duties.

We use automated mastery rules and internal learning-progress calculations. They are educational tools, not high-stakes decisions. A guardian or adult learner can report a suspected grading error or mastery decision through [email protected]; we will review the relevant activity and correct a verified error.

Children and parental authorization

Before a child profile is activated, the adult must create or approve the account, identify their relationship to the child, confirm authorization, and accept the Parent Agreement. We may use a reasonable additional verification step when risk, age, jurisdiction, or the requested action calls for it. We do not knowingly permit a child to independently create an adult account. A guardian may withdraw authorization and request deletion; this can limit or end the child’s use of Open Learning.

No advertising or public profile

We do not sell or share personal information for behavioral advertising; conduct behavioral advertising; cross-site track learners; or create public learner profiles. Open Learning does not include Google Tag Manager or the persistent Foundation-site identifier. We do not use child data for marketing.

Service providers, transfers, and disclosures

The current approved provider/subprocessor for learner data is Cloudflare, used for hosting, edge security, and service logs. We do not approve advertising, data-broker, cross-site analytics, or social-media providers for learner data. If we add a material provider for storage, synchronization, email, or support, we will update this list before that provider receives learner data. Providers act only on our instructions and under confidentiality and data-protection obligations. We disclose information only to those providers, authorized guardians/adult learners, professional advisers, authorities when legally required, or a lawful successor.

Processing may occur in the United States or another country where a provider operates. For restricted international transfers, we use an applicable transfer mechanism and safeguards, such as contractual commitments, as required by law.

Retention and deletion

• Adult account and child-profile settings: while active, then 30 days after deletion request or account closure.
• Learning activity, answers, grades, mastery evidence, and review schedules: while the profile is active, then 30 days after deletion request or closure.
• Security and synchronization logs: 90 days, except logs retained longer for a security investigation or legal obligation.
• Guardian authorization and request records: 3 years after closure, to demonstrate authorization and handle legal claims.
• Backups: deleted data may remain in encrypted backup cycles for up to 90 days before permanent removal.

Offline copies on a device are deleted when the learner or guardian removes the profile or app data. A device that stays offline cannot receive a deletion instruction or synchronize a deletion until it reconnects. Deleting a profile removes it from active service, subject to the backup, legal-retention, and security limits above.

Rights and review

Adult learners and authorized guardians may access, correct, export, delete, and review an account or child profile, including answers, progress, grading, and mastery information. Where applicable law provides additional rights—such as restriction, objection, withdrawal of consent, or a complaint—they may exercise them. We will verify the requester’s identity and authority before acting, and may keep limited information where required by law.

Learning platform—not a school

Nydus is a learning platform, not a school. It does not provide accreditation, academic credit, a diploma, transcript, legal grade placement, or attendance fulfillment. Parents and guardians remain responsible for compulsory education and any local reporting requirements. “Comprehensive” means aligned to the frameworks identified for each course; it does not guarantee legal equivalency. No school, employer, university, or other institution is required to accept Nydus results.

Acceptable use, availability, and account action

Use Open Learning lawfully and respectfully. Do not share access outside the authorized household, circumvent age or guardian controls, bypass security, interfere with the service, upload malicious code, scrape at a harmful rate, or submit unlawful or rights-infringing material. Open Learning is provided as available: maintenance, internet outages, device limits, and synchronization conflicts can affect it. Offline work may not appear elsewhere until synchronization succeeds. We may suspend or delete an account or profile for safety, security, misuse, legal compliance, a guardian request, or material breach; where appropriate, we will give notice and a reasonable chance to correct the issue.

Content and permitted use

Nydus Foundation and its licensors own the platform, course materials, design, and branding. Learners and authorized guardians receive a limited, personal, non-transferable, revocable right to use course content for personal and educational purposes. Do not redistribute, sell, publicly post, or create a competing service from the materials without permission. Memory courses are educational only; they are not medical diagnosis, treatment, therapy, or advice and must not replace a qualified health professional.

Terms, liability, and governing law

To the fullest extent permitted by law, Open Learning is provided without warranties not expressly stated. We do not limit liability that law does not allow us to limit, and nothing here removes mandatory consumer rights or protections for minors. Subject to those rights, Nydus Foundation is not liable for indirect or consequential loss arising from use of the service. Nevada law governs this agreement, subject to mandatory consumer rights where the learner lives. A court with jurisdiction required by applicable law may hear a dispute.

Security, changes, complaints, and contact

Use a strong adult-account password and keep child PINs private except from an authorized guardian. We use reasonable safeguards, but no online service is perfectly secure. Report a concern, request a review, or make a privacy request at [email protected]. You may also complain to the data-protection or consumer authority where you live.

We will post the new version and effective date here, preserve prior versions on request, and directly notify adult account holders of material changes when practicable. Material child-data changes require renewed guardian authorization or reacceptance when required by law; we will not rely only on continued use for that purpose.
